{"id":5690,"date":"2024-12-09T16:12:03","date_gmt":"2024-12-09T19:12:03","guid":{"rendered":"https:\/\/canosa.com\/?p=5690"},"modified":"2024-12-09T16:12:05","modified_gmt":"2024-12-09T19:12:05","slug":"hipoteca-divisible-e-hipoteca-sobre-derechos-de-superficie","status":"publish","type":"post","link":"https:\/\/canosa.com\/es\/hipoteca-divisible-e-hipoteca-sobre-derechos-de-superficie\/","title":{"rendered":"Hipoteca Divisible e Hipoteca sobre Derechos de Superficie"},"content":{"rendered":"\n<p>El d\u00eda 13 de noviembre del 2024, se establece a trav\u00e9s del decreto 1017\/2024 (el \u201c<span style=\"text-decoration: underline;\">Decreto<\/span>\u201d), el cual establece nuevas disposiciones para impulsar proyectos inmobiliarios promoviendo un desarrollo desde etapas iniciales.<\/p>\n\n\n\n<p>Entre los cambios introducidos por la norma se establecen:<\/p>\n\n\n\n<p><strong>Hipotecas divisibles:<\/strong><br>Las cuales est\u00e1n dise\u00f1adas para financiar desarrollos destinados a:<br>&#8211; Propiedad horizontal.<br>&#8211; Conjuntos inmobiliarios.<br>&#8211; Lotes individuales en proyectos con subdivisi\u00f3n.<br><br>Existen una serie de requisitos los cuales deben ser cumplidos para utilizar este tipo de financiamiento:<br>&#8211; El inmueble debe estar libre de grav\u00e1menes o, si existen, ser aceptados por el acreedor.<br>&#8211; Se requiere un proyecto t\u00e9cnico de subdivisi\u00f3n detallado que describa cada unidad o lote.<br>&#8211; Las partes deben pactar c\u00f3mo dividir\u00e1n la deuda y la garant\u00eda hipotecaria entre las unidades.<br>&#8211; La divisibilidad de la hipoteca debe ser registrada expresamente en los Registros de la Propiedad.<\/p>\n\n\n\n<p><strong>Hipotecas sobre derechos de superficie<\/strong><\/p>\n\n\n\n<p>Donde el propietario de un inmueble puede otorgar el derecho de superficie para desarrollar un proyecto.
