Resolution No 15/2020 (the “Resolution”) published on May 22, 2020 within the framework of the “Institutional Strengthening Program of the Judicial Power of the Nation” establishes the regulation for the electronic filing of communications with foreign entities to the Judicial Power.
The Supreme Court of Justice provides for the electronic filing of communications, reports or files, regulated in section 3 of the National Code of Civil and Commercial Procedure, which are repeatedly managed with public offices, notaries with registers and private entities; likewise, the communication of lawsuits against the National State to the General Treasury Office provided by law No. 25,344 will be included.
In relation to the communications in which precautionary measures or other types of measures that exceed the reports are issued, they will be part of this procedure granting them a specific treatment.
A new tool will be available for the Electronic Filling of Communications to External Organizations (EFOTEO).
From the effective date of the Resolution , each public and private body that, repeatedly, requires information from the national or federal courts, must possess a Unique Identification Code for External Organizations (UICEO) in order to establish an indubitable identity identification.
To obtain the code and password, the head of the office for the management of judicial communications must complete a web form on the website of the Judiciary.
When the management is processed by the Courts, it will be completed in the form of an electronic letter to the recipient. In other cases, the official letter must include the resolution that orders it and, where appropriate, the documentation and proof of payment of the corresponding fee.
Unless expressly stated otherwise, access and use of the system and its contents and services will be free for all organizations.
The Court may deny, withdraw, suspend or block access to the content or the presentation of services to those organizations that do not comply with the conditions set for the use of EFOTEO.
The request will be considered completed when it is available in the destination account and the term will begin to be calculated according to the date and time of the server that registers the transaction.
