On November 12, 2024, the National Executive Branch, published Decree No. 1005/2024 (the “Decree”), which deregulates the postal market by introducing changes in the requirements to carry out the activity of postal services, domestic and international.
Among the changes are:
– Simplification of the registration: the registration procedure of postal operators before ENACOM becomes electronic, free of charge and declarative. This procedure eliminates the need to be in person, is carried out only once and allows starting activities in five days. In addition, carriers of parcels up to 50 kg are exempted from registration if they are registered under transport regulations.
– Opening of exclusive services Services such as document letters, telegrams and money orders may be offered by any postal operator, provided they comply with regulatory requirements.
– Responsibility of the Official Mail: The Official Mail of the Argentine Republic will continue to be in charge of the Universal Postal Service and the Electoral Service, unless another provider is designated.
– Digital identity verification: Remote identity validation is enabled through RENAPER, using biometric technology or other methods.
– Expansion of the concept of postal activity: “Couriers” are included within the postal market, allowing individuals to perform only urban courier services related to transportation and delivery.
– Liability for damage: Operators shall indemnify for loss, misplacement or damage to postal items. For this purpose, insurance or surety bonds must be taken out.
– Prohibition of dangerous or illegal shipments: The transportation of dangerous or illegal objects, drugs or any material that violates the admission rules is prohibited.
– ENACOM will be responsible for enforcing and supervising the provisions of the Decree.
It granted autonomy to local and international operators to decide key aspects of their activity such as, necessary personnel, work and operation modalities, types of services offered, equipment and transports, required facilities.
The Decree also establishes that the prices and conditions of postal services, both local and international, will be freely negotiated between the parties, without government intervention.
