On November 21, 2024, the Central Bank of Argentina (“BCRA”) issued Communication “A” 8133 (the “Communication”) incorporating two exceptions for the payment of imports of goods with customs registration.
The exceptions are:
- being able to make payments “on demand” or deferred payments before 30 days from customs entry;
- and to make advance payments for capital goods.
To take advantage of these exceptions, one of the following conditions must be met:
- the payment is made through an exchange or arbitrage using foreign currency funds in a local account;
- or it is made at the same time that foreign currency financing from local financial entities that meet certain requirements is settled. Payments for imports of services. For imports of services made after December 13, 2023, the BCRA has also introduced two exceptions that allow advance payments without following the normal deadlines. These are: a. the payment is made to a counterparty unrelated to the importer through an exchange/arbitrage; b. it is made with funds from an import financing of services from a local financial entity that meets certain requirements.
This communication became effective on November 21, 2024.
