On July 25, 2025, through Decree 433/2025 (the “Decree”), the Executive Branch introduced amendments to Law 26,522 “Audiovisual Communication Services Law” and Law 27,078 “Argentina Digital Law”, which regulate Information and Communication Technology Services (“ICT” Services), with the aim of providing greater freedom for the development of the communications system.
Amendments to Law 27,078:
The Decree simplifies and streamlines the procedures for obtaining licenses established in Article 95, eliminating the administrative process of publishing oppositions and evaluation to obtain subscription broadcasting service licenses.
It also establishes an exception to the prohibition on obtaining ownership of a subscription broadcasting registration for holders or shareholders who provide a public service in the case of nonprofit legal entities and providers of the Basic Telephone Service whose license was granted under Decree 62/90.
These entities are subject to the following obligations: maintain separate accounting for other public services they provide, avoid anti-competitive practices, and allow third-party access to their physical infrastructure under market conditions.
Amendments to Law 26,522:
The Decree replaces Article 30, exempting nonprofit entities from the prohibition on holding licenses for audiovisual communication services, even if they are already holders or shareholders of companies providing a public service.
The Decree came into force on July 26, 2025.
