Authorization for the Implementation of an Exception Regulation to the Free Allocation of Spaces for Ground Handling Services at Jorge Newbery Airport

On February 13, 2026, Resolution No. 6/2026 (the “Resolution”) was published in the Official Gazette of the Argentine Republic, whereby the National Airport System Regulatory Authority (the “ORSNA”, after its spanish acronym) authorized the implementation of the “Exception Regulation to the Free Allocation of Spaces to Ramp Service Providers at International Airport Jorge Newbery” (“AEP”).

The measure was adopted following a submission by the concessionaire Aeropuertos Argentina 2000 S.A., which demonstrated that the terminal has limited operational capacity, preventing the unrestricted entry of new service providers without compromising operational safety and service efficiency. Furthermore, the Resolution was issued within the framework of ORSNA Resolution No. 65/2025, which established exceptional criteria for cases in which the physical capacity of airport infrastructure is objectively saturated.

Among its most relevant aspects, the following should be noted:

  • The exception regime applicable to AEP does not constitute an arbitrary restriction but rather a reasonable and proportionate regulation of access to a scarce resource, grounded on technical and operational considerations.
  • The right of air operators to self-provide ramp services is reaffirmed, with this modality being prioritized even under the exception regime.
  • The concessionaire is required to maintain an updated registry of the types and quantities of ramp equipment, in order to ensure proper infrastructure management and the safe coordination of vehicle traffic on the apron.
  • The measure is consistent with market-opening and deregulation policies, while preserving operational safety as a guiding principle.

The Resolution entered into force on the date of its publication.
