Creation of the Labor Jurisdiction in the City of Buenos Aires

On January 16, 2025, Law No. 6790 (the “Law”) was published in the Official Gazette of the Autonomous City of Buenos Aires, establishing the Procedural Code for Labor Justice within the City (the “Code”). This new jurisdiction coexists with the National Labor Justice, offering an alternative avenue for resolving labor disputes.

The Code introduces key principles such as orality, speed, free access for workers, concentration, consistency, progressiveness, digitalization, and virtual proceedings. It also grants the option to initiate legal action either before the National Labor Justice or before the newly created jurisdiction within the City.

While it retains essential aspects of Law No. 18.345, which governs the National Labor Justice, it incorporates new provisions, including:

  • A simplified procedure for claims involving liquidated or easily liquidable sums.
  • The possibility of resorting to arbitration.
  • A special mechanism to review rulings from the Jurisdictional Medical Commissions.
  • Regulation of eviction in cases where the employer has provided housing to the worker as part of the employment relationship.
  • The incorporation of preventive legal action for damages, applicable to situations such as breaches of occupational health and safety regulations, acts of discrimination, or workplace harassment.

The regulation of the Law and details regarding the full implementation of the new Code are yet to be defined.
