On September 17, 2026, the Argentine Senate passed the bill amending the tax procedure framework (the “Bill”) and establishing new conditions for the simplified Income Tax return regime.
The bill, known as “Fiscal Innocence II” primarily amends Tax Procedure Law No. 11,683 and Law No. 27,799, expanding the scope of taxpayers eligible for the simplified regime and redefining the events that may trigger the loss of its benefits.
Below are the main aspects of the passed Bill:
- Significant Discrepancy: The scope and criteria for significant discrepancies that may lead to the loss of the simplified regime’s benefits have been expanded and redefined.
- Differences between the original simplified tax return and an amended return will not be deemed a significant discrepancy, provided the latter is filed within 15 days of notification of the administrative assessment or official determination, and any resulting tax balances, along with applicable interest, are settled.
- Discrepancies related to the 15% percentage adjustment will not be triggered when the determined difference does not exceed a minimum threshold equivalent to 5% of the amount established for simple tax evasion offenses.
- 25% Reduction in Fines: This benefit applies to micro, small, and medium-sized enterprises (MSMEs), natural persons, undivided estates, and non-profit entities, provided they are not classified as Large National Taxpayers, for formal infractions under the Tax Procedure Law.
- Expansion of the Simplified Income Tax Return Regime: Quantitative limits on income and assets that previously restricted access to the regime have been eliminated.
- Deadline for the Disclosure of Funds: The deadline has been set for December 31, 2027.
Why Is This Important?
The measure seeks to foster enhanced conditions of certainty and trust so that taxpayers holding savings outside the financial system can integrate them into the formal economy through bank channels that encourage consumption, investment, and credit. In doing so, it aims to boost economic activity while offering taxpayers greater benefits and predictability by significantly expanding the number of individuals eligible for the simplified Income Tax regime.
