On October 22, 2024, General Resolution 1026 (the “Resolution”) issued by the National Securities Commission (“CNV”) became effective. The purpose of this measure is to amend the CNV’s Rules to exclude the subjects that, by Decree 891/2024, are no longer obliged to report information to the Financial Information Unit (“UIF”) in the capital market area.
In this context, the following actors are considered obligated subjects:
a) Trading Agents;
b) Settlement and Clearing Agents (“ALyC”) and other intermediaries with equivalent functions;
c) Integral Placement and Distribution Agents (“ACDI”) that participate in the placement of Mutual Funds or other collective investment products;
d) Global Investment Advisors Agents (“AAGI”) and entities responsible for managing the client’s file and risk profile regarding the prevention of money laundering, financing of terrorism and proliferation of weapons of mass destruction (“PLA/FT”);
e) Financial trustees regulated in Chapter 30 of Title IV of Book Three of the Argentine Civil and Commercial Code, acting in financial trusts with public offering approved by the CNV;
f) Crowdfunding Platforms and other entities authorized by the CNV to operate crowdfunding systems through web portals or other digital media;
g) Financial trusts and other entities authorized by the CNV to operate crowdfunding systems through web portals or other digital media;
h) Financial trusts and other entities authorized by the CNV to operate crowdfunding systems through web portals or other digital media, which act in the form of financial trusts.
i) Virtual Asset Service Providers.
