On October 9, 2024, Decree 895/2024 (the “Decree”) was published in the Official Gazette, which amends Decree 718/2024 and regulates the sale of the majority shareholding package of four hydroelectric companies: ALICURÁ, CHOCÓN, CERROS COLORADOS and PIEDRA DEL ÁGUILA, currently controlled by ENERGÍA ARGENTINA SOCIEDAD ANÓNIMA (ENARSA) and to NUCLEOELÉCTRICA ARGENTINA SOCIEDAD ANÓNIMA (NASA).
These shares will be transferred to the private sector through a National and International Public Tender within 180 days. The Secretariat of Energy, together with the Agency for the Transformation of Public Companies, will be in charge of organising the tender and establishing its guidelines.
In addition, the transfer of assets and personnel necessary to guarantee the operation of the hydroelectric plants is authorised. It also repeals Decree 19/2024, which established previous rules related to privatisation.
The decree came into force on 9 October 2024.
