New Maritime, River, and Lake Navigation Regime

On January 20, 2025, through Decree No. 37/2025 (the “Decree”), the National Executive Branch approved the Maritime, River, and Lake Navigation Regime (“REGINAVE”), aimed at regulating navigation, ensuring the safety of vessels, goods, and people in jurisdictional waters, and contributing to environmental protection, in line with the needs of national and international trade in Argentina.

The goal is to simplify procedures, reduce regulatory requirements, and eliminate unnecessary regulations. Among them:

– The Argentine Naval Prefecture will be responsible for issuing complementary regulations for agreements that allow the provision of regulatory services and vessel certification, in line with the provisions of the International Maritime Organization (“IMO”). Additionally, services and certifications issued by international organizations endorsed by the IMO will be recognized without the need for additional approvals.
– Additional approvals will not be required for the construction, repair, operation, or transfer of vessels and naval artifacts that comply with internationally recognized standards, certifications, and inspections.
– Maritime, river, and lake navigation is governed by the principle of freedom enshrined in the National Constitution. Restrictions may only be imposed for navigation safety reasons, in ports, or for environmental concerns.
