New Regulations for the Registration of Technology Transfer Agreements

Industrial Property Regulations in Argentina
On January 2, 2026, Resolution No. 38/2026 (the “Resolution”), issued by the National Institute of Industrial Property (Instituto Nacional de la Propiedad Industrial, the “INPI”), was published in the Official Gazette. Through this Resolution, the new Regulations for the Registration of Technology Transfer Agreements (the “Regulations”), enacted pursuant to Law No. 22,426 (the “Law”), were approved.

The Resolution repeals the previous regulatory framework, streamlines the registration procedure, and establishes operational, conceptual, and substantive guidelines aimed at providing guidance and assistance to applicants in their filings before the INPI.

It further authorizes the INPI to prepare and approve a new Registration Application Form, as well as to issue all supplementary and ancillary provisions necessary for the implementation and enforcement of the Regulations.

The Regulations, attached as an annex to the Resolution, set forth and define, inter alia, the following aspects:

  • The affidavit as the governing principle of the registration process, emphasizing the inherent linkage between the Law and the applicable tax procedure.
  • The necessary and essential requirements to initiate the registration process.
  • The legal acts eligible for registration.
  • The clarification that any of the contracting parties is duly entitled to request the registration of the agreement.

Both the Resolution and the Regulations entered into force on the date of their publication in the Official Gazette.
