On 18 April 2023, the Financial Intelligence Unit (“UIF”) announced Resolution No. 66/2023 (the “Resolution”), which establishes a new procedure for the exchange of information with foreign counterparts. The Resolution aims to achieve a framework for international cooperation, in accordance with the international standards and best practices of the Financial Action Task Force (“FATF”).
The Resolution replaces paragraph a) of section 10 of Resolution UIF N° 135/16, came into force on 17 May 2023 and incorporates a form for judicial authorities and/or the Public Ministry to request and exchange information with similar foreign agencies.
According to the Resolution, in order to request information, the purpose for which it will be used must be stated; in particular, whether it will be used for intelligence purposes or in a judicial process as evidence. At the same time, the facts that motivate the request must be described and the persons or assets involved must be identified in order to verify that they are relevant to the purposes of the request.
