Energy Market Regulation in Argentina
On February 9, 2026, Resolution No. 33/2026 (the “Resolution”), issued by the Secretariat of Energy of the Ministry of Economy, was published in the Official Gazette. Through this Resolution, a National and International Public Tender was launched for the purpose of selecting a single private marketer-aggregator to import and commercialize liquefied natural gas (“LNG”) in the domestic market.
The selected marketer-aggregator will utilize the regasification capacity of the facilities located in Escobar (the “Terminal”) and arrange for transportation to Los Cardales, Province of Buenos Aires.
The marketer-aggregator must enter into a service and access agreement with the Terminal operator. Such agreement will have a term of one calendar year from the date of execution. However, the full capacity of the facilities will be allocated exclusively during the winter period, from April 1 to September 30, 2026.
The Resolution approves, as an annex thereto, the general guidelines governing LNG imports, access to regasification capacity, and the transportation of regasified LNG for incorporation into the tender’s terms and conditions.
The tender process must be completed within a maximum period of forty calendar days from the date of publication of the Resolution.
The Resolution entered into force on the date of its publication in the Official Gazette.
