On July 4, 2025, through Decree 449/2025 (the “Decree”) published in the Official Gazette, the Executive Branch amended Mining Investment Law No. 24,196 and Law No. 24,466, which establishes and regulates the National Geological Information Bank, simplifying certain procedures and reallocating responsibilities to the Argentine Geological Mining Service (“SEGEMAR”).
The amendments are as follows:
Regarding the Mining Investment Law:
– The Implementing Authority will issue a Fiscal Stability Certificate, indicating only the date of submission of the feasibility study, which will be considered to set the total applicable tax burden for fiscal stability. This measure will avoid delays caused by late submission of information from each jurisdiction regarding the tax base and amount in order to proceed with the certificate issuance.
– Registrants must accompany the sworn statement on works and investments actually carried out with an evaluation report from an independent technical professional, and properly keep documentation and records related to such investments.
– Verification of actual compliance with the commitments assumed by the beneficiary will be the responsibility of the Implementing Authority.
Regarding Law No. 24,466:
– The National Geological Information Bank will become dependent on SEGEMAR, a decentralized agency operating under the Ministry of Mining.
The Decree came into effect on July 7, 2025.
